I received the following

I received the following email yesterday Friday 29th May from Liquidator 2 in reply to my complaint to MS about the non receipt of voting papers. I am not sure how to interpret it. By the way, I have STILL not received the voting papers here in Paris as of today 30th May though I did receive the revised appendix two or three days after it was posted. So the Liquidator cannot claim that they must have the wrong address as is implied in the email . Here is the email (the English is very strange!). Any thoughts on how to reply?

I can advise that your address per the Bank's records was sent the Scheme of Arrangement document on 27 April 2009. Unfortunately, I am not in a position to advise why you are yet to receive them.
If you wish to confirm your postal address presently held per the Bank's records, please email branch(?)kaupthing [dot] com stating the details to be confirmed or call the Bank on +44 (0) 1624 699222.
I appreciate that there are incidences where papers did not reach all creditors shortly after posting. However, in addition to being posted, notices for the Scheme meetings were placed in the Manx and international press and the documents were all made available on the Bank's website at www.kaupthingsinger.co.im. Two affidavits which confirm the printing and postage process including the fact that, where required, documents were issued by airmail have been submitted to the Isle of Man court. I can also confirm that original forms of proxy and voting were received from all over the world.

This information was available at the Hearing on the 27th May - as it was a subject that may have raised its head and the information was necessary.

This issue seems to be

This issue seems to be important - I can fairly quickly add a more detailed survey, collecting the specific date as to when papers were received... that way we can generate more meaningful stats, and potentially create some kind of graph (% who received papers on y axis, date on x-axis.) Could do something similar with just a poll, by having answers for (e.g.) a week number in which papers were received.

One day on from the Court hearing and still no Voting Papers received in South West France.
Have previously received mail from Simpson and IOMG at this address ,so no excuse for not having the correct address.
Two E mails sent to Simpson, not even the courtesy of a reply!
Very concerned re the posting of "Notice of Claims" forms. What can be done to ensure this fiasco is not repeated ?

France, 28th May and no voting papers have ever arrived here, although I did receive the Revised Appendix on time.

At least this demonstrates that my address details are correct. I do not believe this can be written off as "vagaries of the postal system" since the French postal service is very efficient and mail from UK usually reaches me within 2-3 days.

Since it seems my experience is shared by many others I suspect in many cases the documents were never actually sent.

Finally the voting papers arrived in China - 26th May ---- INteresting post mark of 9th May rather than April as suggested by Mike Simpson!!

I presume we will have to wait 5 weeks for our claim forms to arrive !!!

Finally received voting

Finally received voting papers in Miami today.
Envelope ragged and had a sticker showing mailed in Belgium!! But no date.

Need to make sure Homer doesn't use the same mailing company for the proof of debt forms......

Homer sure doesn't inspire any confidence - an accountant that can't add and can't even organise the mail room......and how much is he being paid from our money????

I was apparently down to the

I was apparently down to the wire on Sunday 10/5 -- at that time it seemed the voting forms had to be in Edward Coe's by the next day -- and I still had not received anything!

I finally downloaded the PDF from the DAG website, printed it out, and, because I don't have a scanner, simply took a digital photograph of the filled out and signed form (pages one and two).

After tweaking for contrast, and cropping, I then sent that as an attachment to the email address for Edward Coe.

I wasn't about to let somebody's incompetence -- or worse, benign neglect/sabotage -- stop me from registering my vote.

I don't have time to fully keep up with all that is going on, but it seems to me that those responsible are dragging their feet so far behind them, they're never going to come up to speed.

And we all will be made to suffer for it.

Still no voting papers nor amendments to me in Bahrain although a colleague ( Class 1) using the same c/o address has received both, for his 2 accounts. I'm Class 2.
Glad I already downloaded it and sent it back. Not happy that to get in in time I DHLd it. With the change in date I could have used normal post and saved a few dinars!

May 19th today... We each received our revised explanatory statements yesterday evening, but no voting papers - yet...

I also haven't had an acknowledgement for our votes from Edwin Coe or DAG, and was similarly concerned - but I know they were received (by courier) and signed for, so am assuming/hoping that the DAG Team are simply inundated... I did receive a prompt acknowledgement for a legal contribution though - done through Paypal on the 14th.

Actually I would rather people sent their votes by email or fax (with a back up by mail). I am becoming increasingly concerned that they will call this a non-vote (I am convinced as it stands the SoA will be voted down unless there are further Mugabesque shennanigans with the results. This could delay the liquidation further with another postponement due to their own incompetences.

Today I received my...........yes you guessed it - revised explanatory statement. No sign as yet of my voting stuff. I am also somewhat concerned I have not had an email acknowledgement from Edwin Coe or DAG for my vote and a legal contribution respectively both made on Mon May 10th.

I suppose that I, too, should be 'astonished' to have received nothing (in Brazil 18/5/09) - no voting papers, no scheme of arrangement no amendments to them.

But, of course, I'm past being astonished at any incompetence associated with this shambles. Especially as the Provisional Liquidator told me that the original documents were sent by 'Royal Mail Air Mail' which in the event they almost certainly weren't.

But then listening to the Phone-In Question sessions and a presentation at one of the road shows (which didn't present the slides to which he was referring) the LP seems to know little of what's going on - or if he does, he's not telling.

Dear Mr Simpson

I was astonished to receive today your letter dated 12th May 2009 (the envelope of which is clearly franked "14.05.09-PM") concerning a 'Revised Appendix 1 of the Expanatory Statement of the Scheme of Arrangement".

I have received no previous (and thus unrevised) document to which this could refer. Through consulting the Kauphtingsingers.co.im website, I learn that this "Explanatory Statement" was intended to assist creditors in casting their votes at a meeting which takes place tomorrow (19th May), and for which the deadline for appointing proxies was Friday 15th May.

The non-arrival of these documents has effectively disenfranchised me. Furthermore consulting the various websites, among them that of the Depositors Action Group, listed under your rubric "Useful Websites" I find that I am by no means alone in failing to recive the Statement and Proxy forms.

I note that it is permitted for those who have already registered their votes to change them by 27th May in the light of the revised Appendix.

I hope that you will also see fit to extend the same deadline to those who, like myself, have been disenfranchised by the absence of any communication from you about the vote. I would appreciate your prompt reply to this point.

May I furthermore suggest that you carry out a survey to discover how many creditors have failed to receive the necessary documents and have thus been disenfranchised. If this number is sigificant, it will have consequences for the validity of the voting process.

In my experience post from mainland Britain and the Isle of Man to The Netherlands takes on average 3 to 4 days (as was the case with the Revised Appendix). Unless of course it has lain somewhere, as the Revised Appendix evidently did for at least a day and a half between its being dated and its envelope being franked.

Question: Why does Mr. Simpson, of the 'independent' accountancy firm PriceWaterhouseCooper have an email at the domain of Kaupthing hf, the parental company with which KSF(IoM) is in dispute about a parental guarantee.

Question: Why are Mike Simpson's updates on the domain "http://www.kaupthingsingers.co.uk" the so-called independent though sisterly company of KSF(IoM), when KSF(IoM) is in dispute with KSF(UK) over the matter of a missing 500 or so millions of pounds?

klauseriksen, Class 1 voting forms also missing. Our account is well over £50,000 but, as we have our two adult children also listed as joint depositors, we all qualify as fully protected depositors (ie. Class 1). As of today, May18th, none of us have received the voting forms. Living in a major city in Canada, we normally receive mail from England within 4 days. Even a ship crosses in 5 or 6 days.

I don't believe any particular group were treated differently. It was simply a matter of incompetence on the part of those charged with protecting the interests of the depositors.

My Papers arrived or rather

My Papers arrived or rather i picked them up from the PO at 1.30 they arrived there this morning , the revised balance sheet arrived Thurs/ Friday but as it was a local fiesta on Friday , this was posted in the IOM 14th May and arrived in 4 days even allowing for fiestas, weekend etc . now the scheme / voting papers I am told these were posted/ Franked IOM 27 April . Mine have been via Madrid Aptdo 20 28820 , were they sent out by a bulk mailing company and then distributed from there?
They are not even marked as airmail , so can I ask if I can get a letter telling me that sorry we cant count / OOps mistake in 4 days why could they not do it with scheme papers , how the hell am I supposed to read, absorb, calculate what is the best way forward , fill it all in and return it by the morning, as prior to the papers it was all hearsay and gossip.

Thailand I am only in Spain , I can feel another delaying tactic in this , OK chaps lets give everybody another month to get the proper forms back , as I bet the emailed copies will not be allowed or there will be some other technical/ legal reason for more fees / costs to be accrued.
Pretty colours the forms should make good paper planes

Yes it would seem so. I am a group 2 depositor currently living in Azerbaijan and only received my voting papers today. What is interesting though is that a colleague of mine here in Azerbaijan who is in group 1 received his voting papers a week ago. Hence it would definitely seem that sending out the papers to group 2 was delayed compared to group 1. I for one do not trust anything which has to do with the IOMG anymore.

Amended balance sheet arrived here in the Alsace on Saturday May 16, (ie within 2 days), but then they put the correct postage on that one..... Could honestly be weeks before we see the voting papers if they didn't get the postage right.

It is so clear that the IOMT is doing everything in its power to get this SoA voted in, but I really didn't think that they would stoop so low to get people to change their votes, by saying "Oh sorry we got our numbers wrong, so now you can change your vote and accept the SoA as you're so lucky to be getting a guarantee of 70p before we get out dosh back." Do you think they have been asking Gadaffi or Chavez for advice??

Interesting that the amended balance letter is dated 12th May, but apparently no mention was made of this monumental revelation during the roadshows...Interesting that this letter (with the notice that one can change one's vote in view of the amended balance) has arrived before the voting forms for so many... Interesting that all of these packages now en route contain information that is outdated - and this is much more significant than Simpson is letting on. For goodness sake, with a 50p/£ return, our expected realisation drops to ~£120M - only twice as much to go around 11,400 depositors as Whelan got back for himself - how does that feel?

Amended balance sheet posted Douglas, IoM 14 May-pm, arrived today here in Brittany too (postage paid airmail) - also received by email. Needless to addI still don't have the original documents.

This latest would have come as a real bolt from the blue for anyone still unaware that a vote was going on in which they should have sent a proxy by yesterday! The LPs could at least have taken the opportunity to include a note saying there had been a problem with posting and that anyone not having received notice of the vote should contact them immediately. But no - nothing of the sort!!

I think that what they mean by "original" is that they want an original signature, but not necessarily on their original voting papers. A downloaded copy, e-mailed and then mailed by regular post should suffice.

I too am in the land of the rising sun and the slow mail boat. I down loaded the voting form and posted it off (hopefully) just within the deadline. BUT now I understand that my vote won't be recognised as valid without the authentic voting paper back up. There's a 'Catch Twenty Two' somewhere here, or is it a rat I smell????

As of today, May 15th, we, in the capital city of Canada, have still NOT received our voting forms.

Mail delivery is normally received within 4 to 5 days from England as demonstrated when we recently received notification that our EPS2 payment had been processed.
