DAG Representative Committee

In his correspondence of November 19th to other parties involved in this debacle (in particular Cains and Gough & Co.), John Wright, the DAG Advocate in the Isle of Man, requested an informal committee of creditors be assembled with the objective of liaising directly with PWC and the IOM Government with regard to proposals and strategies for KSFIOM. As a result of this and the immense efforts of depositors this request has been granted.

As you all know, Alix & Partners were appointed by the IoM government to identify and develop restructuring plans for the bank as well as to carry out due diligence on the assets of KSFIOM to identify their liquidity and current market value. Over the past few weeks they have been working alongside the IoM Treasury and exploring a number of options for our bank. John Spellman, Director of the Financial Services Division for the IoM Treasury has been in discussions with a number of depositor representatives over the past weeks and has agreed to the formation of a committee of depositors which the IOM Government will use as a sounding board for all proposals for the future of the bank and our deposits.

The committee has been carefully put together to represent the demographics of the DAG as best as possible and includes the following members:

Higher Value Depositors: DaveBraddan, Ally and Diver
Core Depositors (under 50k): Willumcat and Emabroad
Small Business: Nixi
Bonds/Investments: Teapot
In-Transit Funds: Sleeplessnight

In the next week this committee will receive a selection of proposals for the future of KSFIOM and a conference call will take place to discuss this information. In the court hearings on the 14th and 29th of January, the IoM government will outline all these proposals and announce which have been rejected and which are being looked into further based on the responses of the committee.

It is important to note that the committee WILL NOT HAVE AUTHORITY to make a final decision on the fate of the bank on behalf of all depositors. When a solution has been devised that the committee believes is in the best interests of ALL (and there will have to be compromises on all sides), it will be put to a vote of ALL depositors with the results of this vote being presented to the court. Only then will the court make a decision on whether or not to proceed with the suggested plan.

Due to the commercial sensitivity of the discussions the committee will be having with the IoM Government, there will be some things which cannot be broadcast to the DAG as a whole. The committee will, of course, report back with as much information as possible, but would ask for the DAG’s trust and support to pursue the objective of the return of 100% of depositors’ money.

Further Strategy & Actions

As always our objective is to recover 100% of our money at the earliest opportunity, recognising hardship and long term difficulties that arise from our varied situations. At present our strategies are as follows:

• the unofficial committee will receive and review the proposals of IOMG
• formalizing the DAG - a constitution is currently being drafted and is nearly complete and will be uploaded for consultation
• continue to explore legal avenues and to continue investigating the culpability of various parties in our situation with the aim of seeking recompense where appropriate
• ongoing press releases based on developments and human stories - these are uploaded to the public site and an explanation of distribution can be found there
• building on existing political network of sympathetic and active MP's and representatives
• lobbying of UK MP's to push HMG to act decently with regard to: it's actions to date, clause 27 si2674, representation for IOM to Iceland and the recompense of the depositors of KSFIOM
• lobbying Iceland to honour the parental guarantee given to us by KHf.

This is a very significant step for all of us and it brings us closer to understanding our situation and what is being done to achieve the best possible outcome for all.

I think it is important to recognise EVERYBODY’s efforts in bringing about this progress as you’ve all contributed to this in one way or another. By supporting the legal routes both in the UK and the IoM and by keeping up the pressure on politicians on all sides of this mess we have now achieved one of our major goals in getting a serious official dialogue going with the IoM authorities.

It should be noted that special thanks for getting all of this sorted out should go to Sleepless, Dave, Teapot & Ally who have worked tirelessly behind he scenes to help make all this happen. Sorry if I've missed anyone out but if I have...thank you too!

Thank you all for all your magnificent efforts and your support and understanding over the past months. I hope that this news brings a little bit of cheer to an otherwise sombre holiday season. Please try to have as merry a Christmas as possible and let’s hope the New Year brings us all much happier times.

Firstly, thanks to Diver and your timely up-date. You are indeed a very clever individual, like the majority of the core group and, of course those that keep them on their toes. Nevertheless, I know none of you but, feel I know you all, to a degree. I am so lucky to have such great, talented people trying to recover all of our money. I do think that we should not be trying to distinguish between depositors who have up to and, those that have more than 50K. If the DCS is activated, we all will be waiting a very long time, indeed years to receive the 50K. So the DCS should not be a consideration, it should be, the very last resort, when all else has failed. So, whatever the plan, put the effort into finding the alternative and make the alternative work, it will be the best solution for those that have more and those that don't.( 50K) Whatever you do, you will have my support, as you have proved so far, that you are our only hope of not being stitched up here. Again, well done so far and a very grateful big THANK YOU ALL, core, committee and contributors.

The iom govt know none of us will go away till this brings back a soloution to our rightful funds which were seized by a govt who are clinging to power by threads. We are all real people here and we have to ensure others cannont just sentence unfairly what was their severe mistakes from the start.

Great work by the team. It seems evident by the reponses thus far that the team has the support of the vast majority of people. Keep up the great work
"you can please some of the people all of the time etc.etc" applies - The DAG forum has been marvellous for everyone and is at its best when it is a collection of thoughts and ideas of the members - (2,000 minds are better than 1) Some are insightful, some are zany but we need to keep feeding and supporting the team and let them represent us ALL as they are doing so emminently. Let the negative be ignored and fall by the wayside.

Please - Dave, Ally and Diver - bear in mind that this covers a very wide range, from those (like me) with not much more than £50k to those with over £500k. Of the 240 people with more than £50k who have joined one of the groups set up here, rather over half (134) have between £50k and £250k (which is already a rather wide range). I don't know to which of these groups you three belong (nor do I need to), but trust you will keep us all in mind.

It is a good progress. Not all the +8000 depositors are active members and also majority are are stationed in diffirent parts of the world. For example I am a one of the depositors do not know or met any of the proposed committee, there is no way of selection by vote but just have to belive and trust in good faith. In my my openion there is nothing wrong if the active members of the DAG are to become a part of the committe.
I strongly recomentd and vote in favour of the suggested comittee ( DIVER + HIS EXISTING TEAM ) and hope that they will work to safeguard the rights of all the depositors.

... and just what we needed to hear. I had decided to give this site a miss on Christmas day, but couldn't resist my daily fix this morning. To my great surprise I found this unexpected Christmas day gift!

This is a great step forward and more than I would have thought possible. Well done to all those who pushed for this tirelessly while others bickered because there was 'no news'. As far as I can tell, all those selected for the 'committee' have worked hard for the cause and inspire confidence. Doubtless there are others as well qualified, but so what? Most of us would have no clear basis for voting without statements of position etc etc - and we have no time for that. We can only move forward with trust - we count on you not to let us down.

To be working in the early hours of Christmas Day to make sure we get this news before Christmas just shows how much effort you have put into this for us all. Thank you Diver for the update. We very much appreciate the efforts of all of you in the 'core'. We are right behind you. Lets get on with your proposal ASAP. The committee you state sounds just right. We have met some of you and have seen the high effort that you all have put in so far. We hold you all in high regard. So if there was a vote it would be no different than that you propose (as far as we are concerned). Lets not mess about and get on with it.

One of my New Year wishes is that the stupid and offputting bickering on this site dies away and we all continue to pull together. Increase the effort if possible.

Thank you Diver and Co for doing this. I noticed that you posted the message in the very early hours of the morning on Christmas Eve, which just goes to show how much of your personal time you are all putting into this.

Looking at the committee members, it seems as though we have the best, and those who can represent the best interests of all. The names of the people are those who have been tirelessly trying to sort out this mess since the very beginning. This will be the best Christmas present ever for my parents.

Whatever the outcome of this fiasco, my parents know that without all of you, KSFIOM depositors would have disappeared into history long ago.

The committee is a good development. However, I have reservations about its composition. And I think those on it ought to be elected representatives of the depositors, even if election is only by means of a poll on the forum.

I also think it is a poor idea for the committee, which does not speak for the majority of depositors to have the authority to block certain proposals from being put to the vote. By this I mean that, as described above, only those proposals that are approved by the committee will be put to the vote of all depositors.

Lastly, I suspect that the IOM Treasury will try to use the committee as a means of promoting certain proposals which might otherwise not be acceptable to the court.

Elgee, I don't think that we have time to elect members of the committee, as the 15th Jan. will be upon us before we know it. Even if we do vote, not all depositors are on this forum everyday, and there are thousands of other depositors that don't even know about DAG, so the results will be warped anyway.

I think that we just have to be grateful for all the efforts of the above members, and even though it's impossible to please everyone, it's our best shot at getting the best results possible.

Will you take the trouble to read the posts put before you?

The committee in no shape or form will have the power to make any decisions that would not ordinarily have been made by majority voting from what would have been a creditors committee. Whether or not a proposal may be acceptable to the committee is neither here nor there, all creditors would have to be approached, and I see nothing in Divers summary that suggests that they intend to block any proposals in the manner that you suggest - it wouldn't get past first base if it was tried in anycase.

Do you think any of us will approve the committee making a decision that is not approved by way of a vote of all depositors whether or not registered with the DAG? You are well aware that the law wouldn't allow it anyway.

You mention that you have reservations about the composition of the committee, would you care to elaborate? are you saying that there are members who you don't consider suitable, or is there a touch of sour grapes here? Much better for you to state what you mean instead of attempting to stir up other depositors.

Rather than wasting further time and resources on voting for and against members of the committee - let's stop messing about, if anyone has any objections to any member on the committee then state it, and the reason. How can I vote for individuals that I have never met or indeed conversed with? I have to go with the flow and believe that everyone is working towards the best end solution - this isn't a local government election where we choose the best liar, those already proposed have already proven that they work with the best intentions of the majority as their primary objective, and that on it's own is good enough for me.

I am more than happy to talk to you or any other depositors. My contact details on this forum have always been enabled and I think I have always replied to any email I have received. If anyone wants to put ideas to me or to see what sort of ideas I have than they are more than wlecome to email me.

I do live on the Isle of Man but I am no way biased towards the IoM govt and they and the FSC have many many questions to answer. However my current stance on this situation is to recover as much as I can as quickly as I can, if that is 100% fantastic, if it is only 50%, not good, but at least I have it in my hands instead of limbo, like now. Then I will see what other action needs taking. Right now one way of getting as much back as quickly as possible might just be working with the IoM govt and so lets see what they put on the table and hopefully we can shape it more to our liking.

Depending on the return from any scheme then further action or whatever sort is not to be ruled out. However whether this action be legal or other, currently I see that as secondary to a plan to payout. That does not mean I will not resort to that and all the while I gather information that is relevant or may become relevant to such action.

I have had emails with other members of the committee but the only other member I have met is Dave Braddon and all I can say about Dave are good things. He has worked tirelessly to always keep the lines of communication open with the IoM govt and when he has had to say things that we knew the IoM govt would not like he has always said them.

It is probably a good thing that an individual depositor doesn't agree with all the representatives put forward as that probably means they represent the different views that are present on this forum.

As I say if anyone wants to put ideas to me or disagree with me then they are more than welcome to get in touch.


under 50k position

It appears to me from my discussions with another committee member this morning that those depositors with <50k may well find themselves getting stitched up by this new move.

I think the position of the <50k group ought to be:

(i) to insist that any proposal which avoids triggering the DCS is only considered viable if those who would be fully compensated under the DSC (if it had been triggered) are still fully compensated under that proposal;

(ii) there is no reason why depositors with less than 50k should have to make any concessions involving less than 100%, since they are legally entitled to be fully compensated.

In any event, that is now my position.

Odd that.
I cannot see anywhere written that less than 50K'ers should have to compromise. Are you suggesting that those over 50K'ers should not seek a solution that does not compromise other parties but still returns as close as possible to our original deposits?

I'd figure it something like this:-

1) Those with under 50K deposited should see the same return from any action that Alix/IoM/PWC/whoever are taking in a similar timescale as they would had the DCS been activated.

2) Those with more substantial deposits should let ANYONE talk them out of achieving the best possible return of their entire deposits.

Would seem quite clear that these two objectives are not mutually exclusive and are quite achievable. I am wondering why we find it necessary to attempt to continually drive a wedge between depositor groups when in reality the common aims are really quite similar.

I am wondering if you are aware that under the DCS, sub 50 K depositors would not necessarily get an equal payout on the first "dividend", and that they payout is in fact graduated until full contribution have been received. A 10K depositor and a 200K depositor would not necessarily see the 10K depositor full paid up, with the 200K depositor getting 10K - it is all in proportion to the size of the deposit and the amount of money in the scheme pot. You need to be very careful what you wish for, you may just be stabbing sub 50K depositors in the back by insisting upon DCS like terms for them.

so you have no conscience whatsoever to people like us who have sold our houses and put our funds in there for one day being on the 6th oct which may I add we dont even have proper accounts, didnt get paid one bit of intrest, so my share is helping others in their recovery ,yours included, we are in a group here to help everyone . There are human rights issues here so just for one minute examine what you write, .

I'm a sub50K. I'm willing to postpone repayment if this helps larger depositors. I want this injustice made right. Lots of us feel this way.

I said nothing of the sort. That is your assumption and it is incorrect.

Why don't you ask Andy who runs the website and Diver and Sleepless about my conscience and what I have done in the past for depositors at large and individual depositors in hardship? Also, ask who it was who pushed the hardship issue at the political level and legal level at the outset.

I ask that all of us be tolerant of each other's opinions, and also of each other. Stress releases bitter words. Please look into your hearts when you respond to a message. Be aware that we are a diverse group with little in common except our temporary loss.
Try to respond to messages in a positive frame of mine. If a message angers you, have a cup of tea and a nice sit down (away from the computer).

Just show compassion, I have an only child that I am not with this christmas due to this mess we have been put in through no fault of our own but a greedy financial adviser who thought only of himself and commited financial suicide with our funds. Imagine how many sedatives me and my husband were on from the start of all of this.

I've noticed quite a number of others making contributions big and small, some by way of financial gestures, some by actions, and others just by suggestive and progressive thinking, what has made in general these actions so full of humility is that pretty much every contributor has managed to avoid being so ungracious as to remind others just how much they have done.
