In light of the recent events although slow but some movement in the positive direction, we have to email MICHAEL WELDON at the FSC to stop the wind up of KSF IOM and prevent liquidation. PLease do this TODAY to STOP KSF IOM WIND UP and PREVENT LIQUIDATION. Mr Weldon has asked for our support to help him as petitioner to ask for ADJOURNMENT on Friday 24th OCTOBER to prevent wind up of KSFIOM.

I've followed suit, still waiting for a reply. I have also sent a message to my local MP, Gregory Barker, and he replied very swiftly. He says he will write to the Chancellor of the Exchequer - very promising and positive reply from Gregory. Just waiting to 'hear' from Mr. Darling.

Have considered sending a letter to the European Court of Human Rights, but I am not sure if this is a good idea? Anyone got any thoughts on this? If things go very badly, many people are going to be substanially out of pocket, so I thought the Human Rights angle worth pursuing.

Recvd same response as others for adjourning. BTW I do believe that if not adjourned ( which I hope & pray doesnt happen ) that there will be a 'smell' of conspiracy somewhere, as all the pointers strongly indicate to delay liquidation, just too many other potential avenues to save this!

Thank you very much for your prompt reply.

Unfortunately I am unable to make a personal representation at the court tomorrow 24th October 2008 since I am, if you had read my email and not sent a generic reply, an UK Citizen / non-UK resident some 9000 KM's and 7 time zones from Douglas. As much as I wish to be at the hearing I do not have the 800GBP for the return ticket from Thailand to IoM since all my funds are frozen in this diabolic mess which I am requesting yourself, as the Head of Supervision of the FSC to put my case forward.

You did reply to my email and I have a full trail of our correspondance which is saved offline and not on a server and this is all you can tell me? You allow the UK Goverment to sieze all my assets and now you in your position of Head of Supervision of the FSC fob me off saying I have to represent myself knowing damn well that you have made it impossible for me to attend ... you sir are as bad as the UK Government. This pathetic response will be forwarded to all the press contacts that I have, and believe me over the past 2 weeks I have made many contacts .

Your attitude as Head of Supervision of the FSC just shows the distain shown to depositors in the Manx banking system and does not give much confidence in the future of such, I was prepared to give you the benefit of the doubt but now you have shown your true colours.

I look forward to witnessing lack of confidence in the Manx banking system and the ultimate collapse of your false economy, Seventy Thousand Alcoholics clinging to a rock and you still could not organise a piss up in a brewery with GBP 850 Million of Depositors money.

As I said in previous posting, I have happened to have made contacts with the UK press and I have been in constant communication with a financial correspondent with AP for the past week. The emails including all the trails are now with AP and they are chasing this line along with what Irish Indi put out less than an our ago.

Less than 24 hours to prevent liquidation, the gloves are off now, we need as a team to keep on lobbying, lets give it the big push for this battle and no matter what happens tomorrow the war goes on!

I think its a good idea to inform Weldon whether you are for or against the windup on 24th Oct. I understand that he is listening to depositor's views. I would not provide account numbers - I understand that it is sufficient to provide account title. Here is the rationale I have given to Mr. Weldon:

  1. A postponement would not prejudice our ability to move to windup the Bank at a later date - and therefore nothing is lost.

  2. There has been insufficient information and disclosure provided to depositors surrounding the Bank's current circumstances and the events that have lead to the provisional liquidation. As such it would be unreasonable of the court to windup without giving sufficient time for further investigation.

  3. There are numerous political and corporate initiatives afoot to salvage the Bank's going concern value. This process needs much more time - it's been less than two weeks.

  4. Interested parties (potential acquirers and others) are being frustrated in their efforts to maximize the Bank's value by the lack of transparency in the KSF (UK) liquidation. This matter must be resolved before informed decisions can be made regarding the Bank's windup.

The reason that the case is 'sealed' is due solely to the use of the anti terrorism legislation to freeze the assets - and Cold Dose is 100% correct - probably never. Opening the seal would expose the 'information laid' by HM Government in order for it to justify its actions in invoking anti terrorist legislation.

I suspect that it could be extremely embarrassing for Gordon and his little mates!

It's strange, the basis of the action was as follows:-

" Landsbanki, an Icelandic bank, had been placed into receivership in Iceland.
- the Treasury reasonably believed that actions to the detriment of the United Kingdom’s economy (or part of it) had been or were likely to be taken by persons who were the government or resident of a country or territory outside the United Kingdom."

but since now by definition that cannot be the case ( the UK is loaning Iceland a substantial amount of money less than two week later) - it would seem that the information laid before the court must be flawed.

The order needs a little peek inside.

Great couple of little words there... they permit a multitude of sins.

All they have to do is show that at the time the order was made, they might have thought that their claim above was correct. 'Reasonably' here as in it wasn't completely unreasonable and nobody in their right mind could have thought it true.

In any event, that's the Landsbanki asset freezing order.

What's affected KSF is an administration order, which shouldn't have any anti-terror implications - hence why it is deeply, deeply odd that the papers were sealed.

Well the order cannot be undone, but the contents of it can be made public. The anti-terror laws are super, preventing anything from fuel tanker drivers and police officers striking, to causing the closure of a bank. Only issue is they don't actually work against terrorist, who get paid state benefits and legal costs.

The Capt is dead right. Never ever send information in an email that could be used to commit fraud against you. The way emails are sent there is a posibility they could be intercepted and the data easily read.

Even though the requester email may look legitimate, you cannot be sure. So how do you know you are replying to who you think you are?

Only use websites where the lock is shown and the address starts 'https'. Otherwise use traditional means....

Just listening to Manx Radio AM live on Tynwald debate...this was repeated numerous times.
