LEGAL FUNDING UPDATE 9/12/08 - URGENT

This message is to let you know the situation we are in regarding the funding for legal activity in both the IoM and the UK.

Since the last request for funding we have received a total of 7 donations into the legal pot. As such the bank account is standing at just under £3,000 following all outgoing payments and all donations received. I am sorry to say that this will not come close to seeing us through to the end of January as we had hoped. It may just about cover IoM costs until then (unlikely) but it will still leave us considerably short of what we need to cover our UK legal comittment.

For fuller details of how the funding has progressed to date and where the funds have been spent please see an earlier post of mine on www.ksfiomdepositors.org under the 'funding' tab.

The fact of the matter is that if we do not receive further donations to the cause then we will be forced to cease our legal activity - sorry but it is as simple as that. I fully appreciate that we are in a uniquely bad situation where we need funds to try to recover funds and it may simply be that there is no more that can be spared for legal action. If this is the case then we all need to say a big thank you to those who have dug deep to allow us to get this far.

If, however, there are those who still wish for this action to carry on (and can afford to help out) then please go to www.ksfiomdepositors.org and access the information on how to donate under the funding tab at the top of the page.

I will let you all know what the future holds for the legal action in 7 working days buy which time I will have a better idea of just how much we have in the fighting fund.

Dear Diver,
you say that you 'will let us know what the future holds..........'. I just transferred funds to the Lloyds Bank in Haywards Heath which I feel has been a waste with regard to your insinuation. I am ill and bedridden and would have needed the money I donated badly to buy medicine. If the Lawyers are successful we are abe to pay them well - even a bonus. But requesting constantly fees without result from financially dried out people is typical lawers' scam.

Horst you are helping just the same as the rest of us.
In fact more so its bad enough losing our savings without being ill as well.
None of us are keen to give what funds we have left to lawyers but in this case we need legal representation
and we need all the help that we can get.

Horst - I'm really sorry to hear you are ill and bedridden. You should not be spending money you need for medicine on this.

But I can't understand what you mean by Diver's 'insinuation'? Nor do I agree that Diver has been 'requesting constantly fees' - nor that he has in any way put pressure on 'financially dried out people' - nor even that it has been 'without result' (even though we do not yet have our money back).

If you feel that the legal action (or rather legal consultation - we have not instigated any 'action' in the legal sense of the word - that really would cost) to date has been a waste, then you were quite free not to contribute further. As I see it, Diver is being very discreet (maybe too much so for some) and remaining in the background as he said he would. He has made 3 requests for funding - the first time specifically for the IOM advocate, whose reports are on the public site. Personally these reports, particularly the latest, have confirmed my feeling that this type of legal representation is exactly what we need at this point in time and definitely not a waste. But you are quite free to disagree! The second request for funding was made to enable the appointment of a second advocate to do a similar job in the UK. It seems that a low response to this second appeal was mainly due to misunderstandings about how to contribute and many people were awaiting further instructions. This lead Diver to make a 3rd request, which now seems to be getting a good response.

Diver has always made it clear that no-one should feel in any way obliged to participate and has clearly stated that those suffering hardship and unable to contribute financially (which appears to be your case) could nevertheless be included - provided of course that enough contributions are received to allow the action to continue. I for one am glad that he informed us recently that the action would be unable to continue in the absence of further funding - and heartened by the extent of the response.

Thanks Diver, and all who are helping to keep this going. I believe that legal advice, guidance and representation (not action) are an essential part of our fight to see justice done.

You've tidied up the contribute page. Whether or not it was any way due to my suggestions I don't know. Pity that links to posts don't work on here!

I did make a suggestion of having a link to the contributions page from the left or right sidebar below either the Search box or the Logout Make it easy!

I question whether you need a lot in the bank now. You do need the security of knowing that money will be available. Many DAG members are strapped for cash, why not provide a facility for contributions by Standing Order. An easily downloaded form, print, fill in your bank details, sign it and send to your bank. Maybe only £10/month if enough people do it.... It mounts up

Solicitors should not require payment in advance. Beware the more money they believe is available some and I'm not suggesting the ones we've chosen would, are not averse to charging exhorbidant fees. Let them do the work and pay on invoice end of the month following, same as any other business. Keep an eye on what they do and what they charge.

We currently have 2137 members on the Forum.My guess is, that only 10% contributed last time.I realise we are all in a financial turmoil at present,compounded by Xmas, i've know doubt.But, i for one, would feel a little more comfortable, if it wasn't just the same people financially contributing to the good of all.This is compounded by the comment i have had of late,that us larger depositors within Bonds, should not receive any share of the potential DCS if triggered,as ,i quote,'you should have done better due diligence when you originally invested in bonds' It does make me wonder sometimes,why do i bother? I also fully understand that a few of our members are in real crisis and my heart really does go out to them.Of course we would not expect them to contribute what they haven't got.All that said,i will always try and do the 'right thing' for the majority of members with regard to support.I may not 'lead' the stratedgy thinking, but i am 100% commited to all of us getting our money back,not just the few.I will continue writng to as many people as i can and post all replies as i have done many, many times.I would therefore dearly love to see that same commitment from quite a few others who are out there.You know who you are! Action is needed by all 2137 members either financially or at least lobbying anyone who will listen or read your letters/emails.
Sorry,i am very tired and have had a very stressful day at the hospital.I did want to say this last time funds were asked for,but i held back.
P.S Please, lets not argue over my posting.I guess a few will slag me off.But at least i can go to bed with that off my mind!

I was sure I saw more than seven people say they had made a second contribution pretty much as soon as Driver requested it last week. I have a concern, given my now heightened mistrust of the banking system, that not all monies are getting through and at the moment we have no way of checking if our personal contribution made it. I’m surprised that my second contribution would appear to be a relatively high percentage of the 3,000 total. I don’t know if there is any way we can get a check-back that our specific funds have arrived as I’m sure this involves more work for Diver. Any thoughts on how we can check our monies have reached their intended destination and aren’t somewhere in the banking system?

I too was surprised to be only 1 of 7 (now we are 2!) and asked (way below) Diver to contact me if not received. But does no news mean yes? It certainly left my account (on Dec 4 if I remember well). Would be glad to be reassured it arrived - though the recent reactions suggest that many people were waiting, so the 7 may be correct after all.

Haywards Heath is a town in West Sussex, England. Last time I was there, there was only one Lloyds TSB bank in the town itself, but the branch number is very specific to each particular branch.

Sorry to ask the obvious, but if we already have 3000 pounds, then what kind of figure do you think we really need to finance this legal fund?

Would you say we need 5, or 10,000 pounds, or more? Some sort of guestimate would be helpful, to focus minds etc.

It's late again and not right as I find myself unable to sleep and trying to keep up. We've all been hurt and are fed up. It comes out as we struggle to cope and also try to keep informed with any hopeful news that might arise, so we return here. We hope to want to do our best to do what we can, while learning what we do not know.
This is what remains. Daily for more than two months we are faced with the ongoing frustration from the amount of information that is being kept from us and the incredible spin and misinformation published that is contrary to what we do know to be the truth...., not least of all from the Provisional Liquidator.
The dichotomy of this site is that... it is a life saver, ...while also an incredible frustrating time waster.
....Meanwhile lawyers have gotten rich from it, and contributors drop off. We remain getting the short end of the stick, and it seems are fighting it out in our life boat, beating each other with the oars! Valuable contributors are bailing out because members like myself find the difficult daily issue to cope with from coming here is the ongoing struggle between contributors forum comments, which are not intended to be helpful, but are nonetheless valid justified expressions of their legitimate emotions that cannot be expressed easily anywhere else then with those who can relate to in our common crisis and dilemma. Its symptomatic of the actual ongoing the frustration that is compounded as we continue to face to what we up against, as in our worst dreams coming true.
Sadly this results in just backing off and starting to count the losses, and staying away from this site to cope instead of coming here to help cope for peace of mind. I admit I had to do this for week. Losses are continuing to mount on all sides, while life is stalled and stunned. I cannot cope anymore with coming back here to follow every comment posted, or the struggles are seen for example between members like Elgee and Captain Mainwaring over the parental guarantee. I cannot fault them while it's happening with me even at home with those I am closest too. It is just become quite difficult to sort it all out as I once had the incentive to try to do.
I come back tonight to find obviously more doing the same, and Diver pleads for help. Don't you suppose this is what the ongoing delays are banking on after being up against the original opposition this web site presented? Sorry Diver, NG etc. Your dedication is an inspiration and amazing. I'll send more contributions again, I'm 100% behind your efforts. But for the sake of what you express in the circumstancesm is it possible for you or NG to send your important messages direct to legal fund paying contributors?

I reside in and am a citizen of the US. I opened a Pay Pal account specifically so I could contribute more ( I have already contributed) to the Legal fund. However, Pay Pal cannot be sent to the bank per se. I need to know how to contribute via Pay pal, or I well send, by post, a check to the bank. Please advise.

Also, I do not know if my communications are going through to this site. I tried on two occasions to post my thoughts and information, but they never appeared.

Diver, I believe that by now all will have realised that there was, still is, some confusion over the new preferred paying in methods. Its not that the money was not out there ready for donation, it clearly is, but the impression appeared to to be, wait until further instructions were posted. I would respectfully suggest that another all points bulletin be placed on both sites calling for donations of any size and they will surely come.

Girls/Boys the time for us to donate is now, its now up to us to support one of the most talented world class management "A" teams available. We are all so lucky to have had them all LEADING us in our weeks/months of desparate need. From the web site we all know who they are. Look at their results and achievements and think where we would have been without them and remember there are still some big and possibly legal hills yet to climb. We seem to have a good legal team developing and should keep them whatever.

As pledged and along with 270 or so other donators I have previously paid a modest amount into the earlier "Wharf" account. Tomorrow I will repeat this in the new account and continue with as much as I can whenever I can. Every little will help.

Finally the very helpful, friendly and talented ng has resolveda communication problem that has plagued me since the beginning of our 9/10 nightmares. Are other missing depositors ( circa 2000) in the same position ? able to see the web info but unable to register and respond to the action items. If so are there potential donators out there not able to register. For me ng advised using the firefox system and it worked, Are other untapped sources having the same problems. It is very difficult to contact any (technical ) group member with a problem if you cannot register in the first place. ng was " the man" to advise,

Finally Diver I hope that the disappointing slow legal fund build up was not too dispiriting to those closest to it. From the recent forum topics it seems that one option is to offer a larger liquidation payout rather than the full deposit return that we all stand for. We have done nothing wrong, so where is our money?, borrowing is not stealing, if its returned.That being the case then more severe legal action will be needed to recover the differences from the responsible parties.

This challenge is an opportunity for the IOM and its Government to demonstrate the innovative leadership needed to resolve this problem and thus gain respect in the worlds eyes..
