Kaupthing hf - Judicial Review

The hearing of Kaupthing hf (the parent bank) judicial review (JR) took place on 10 July in the divisional court of the QBD, High Court in London, before Richard LJ and another judge. DST is directly in touch with the parent bank's solicitors on this matter and EC are informed and has relevant documents.

Judgment was reserved and will be handed down in October. Khf seeks a declaration that the action taken by HM Treasury in tranferring accounts to ING was UNLAWFUL. If it is found to be unlawful, then it will be argued that that action caused KSFUK to go into administration and damages will be sought by Khf. Obviously we in DST can take the argument one step further and claim that if it was unlawful and if that act caused KSFUK to go into administration then that in turn caused KSFIOM to collapse. I do not think that last step is a hard one to take, although there would probably be argument about causation, but in any event that step depends on there being a judgment given in the JR itself that is in favour of Khf.
