IoM Depositors Compensation Scheme
The letter to Claimants dated 5th June suggests one should consider taking legal advice on whether to claim under the IoM DCS. They state that "you will be required to assign your existing full rights in the liquidation to the Scheme Manager to enable it to pay compensation sums to you and thereafter recover the amounts of compensation paid."
My question is in two parts: firstly how does taking part in the DCS and the "assigning your existing full rights" affect ones rights to claim under the liquidation of KSFIOM beyond the point when the Scheme Manager has recovered the compensation paid to you under the DCS?
Secondly, has an individual who has claimed under one or both of the Early Payment Schemes operated by the Treasury already assigned certain rights in the liquidation process away such that making a claim under the DCS does not further dilute ones rights?
Surely it should be the case that making a claim under either the Early Payment Schemes or DCS does not materially alter ones status as a claimant under the liquidation process beyond the ability of the IoM government to reclaim the payments made to you under these schemes. But is this in fact the reality of the legal position?
