Claim against Kaupthing Bank hf.
I have received a letter to say my claim against Kaupthing Bank hf. has been considered null and void because it reached them too late. This is very cheeky considering we had only a few days t submit the claim just before Xmas. Can someone explain to me what are the implication of this?

Claim too late!!!!
On 01/03/10, I too received a letter dated 11/02/10 from Kaupthing hf to say my claim did not reach them by the deadline of 30/12/09. I sent my claim by Express Post from Australia on 10/12/09 and was told it would take 3 to 5 days to reach Iceland from the day it left Australia. Unfortunately, because it was Express Post I was unable to register the letter, so I had a choice 'register' or 'express' I chose the latter. With the peel off number I thought I"d be able to trace when the claim/letter left Australia and arrived in Iceland. I contacted Australia Post and they said it left Australia on 15/12/09. I emailed the Iceland post office (www.postur.is/english) in Reykjavic and they replied with 'This item has not been registered into our system. Therefore I can not verify the date of delivery'.
I feel that my letter was received in the time but Kaupthing hf is now denying this, what am I to do next?

I just received the 'null and void' letter here in France. I would have been more impressed if it hadn't been addressed to me.... in Germany.
The letter's dated 11 February so it took 16 days to travel from Reykjavik via Germany to deepest France. Which makes me wonder why my claim didn't arrive in time, since I sent it on 23/12/09. Methinks they may have moved the goalposts. Or taped up the letterbox over Christmas.

I too have just received this letter, dated 11 Feb, in France.
Seems they have their wires pretty well crossed since I had a previous notification dated 10 Jan that my numbered claim had been reviewed and rejected on the grounds that "a parental guarantee was extended to [KSFIOM] by Kaupthing Bank hf". My claim is indeed listed as filed (and rejected) on the khf website. In view of the rejection of KSFIOM's claim, I have since lodged objection via our Icelandic lawyers.

I've just got this "Your claim against Kaputhing Bank hf" letter, dated Feb 11, which arrived here in the Far East only a couple of days ago!
The tone of the letter is very terse and unfriendly and I seriously object to the bit where it says...."an invitation to lodge a claim was published in the Icelandic Legal Gazette on 30 June 2009 and translated into all the official languages of the European Union and published in the Offical Journal of the European Union OJ C 192, volume 52..." blah, blah blah. Oh, really?
Well, that's all news to me and to a great many others I suspect, First I got to hear about lodging this claim was in the run up to Christmas. I sent off my letter express post from London then heard precisely.....nothing.
You wonder what's going on here. Didn't PWC know about this? Why did this Parental Claim thing only break to the world at large at Christmas - well, conspiracy theorists may well have a good handle on that one....
Anyway, we can but hope that PWC's "vigorous" challenge to this summary Kaputhing rejection will ultimately work out - in our favour. But will it??

I also got this 'dear John' letter, dated February 11. They simply sent it out to anyone whose claim arrived regardless of whether it was before or after the cutoff date. I too found the brusque, arrogant and self-defensive tone offensive.
So waiting for PWC's response. But not holding my breath.

I have written asking what date they received my letter and suggest everyone who receives a letter rejecting their claim do the same. You may want to dispute they received the claim when they said they did at a later stage in proceedings.

Haven't all of us who even having received a confirmation from KaupthingHf that our claim was received on time within the deadline had our claims rejected anyway due to the inadequate parental guarantee ( making us non creditors amonst the list - disgraceful!).
I sypathise with you that you receiving letters that your claim wasn't even received on time is worse. As by good lawyer friend exclaimed "Who are these people who leave such matters of great importance so last minute (and over the Christmas period too. We have been abused and harassed right down the line - maybe this should be our legal angle - harassment! If only! It really is too much to see how we all are getting treated and played around with!
