CHANGES TO THE DAG TEAM

The central DAG team has always known that my commitments outside of our cause are taking me overseas from mid February. We did think at one stage in our discussions with the IoM that they were capable of getting their house in order and that the hearing at the end of January would provide a more certain position for depositors. However, since the outcome of Thursday's court hearing indicates that our wait for proper information is going to go on beyond my departure date, the team are working to integrate new committed members and bring them up to speed with the happenings of the last 4 months in detail. In addition, since our legal advisers have given such impetus to our position especially in regard to IOMG, we will be giving a more visible voice to this legal advice to help ensure the DAG is kept informed over the next few important weeks. I would ask as a leaving request that you consider a further donation to our legal cause to enable this head of steam that has been created to see us through to the end.

Everything we have achieved to date has been as the result of a group of individuals working very closely together and not just the work of a single person. I may have been the more visible part of this group but you should be in no doubt that it was teamwork and equal input from all that has got us this far. Remember I was away for a month in December and everything continued in my absence. The main body of this team (which I believe to be amazing, but I’m biased) is not changing significantly in the short term and will continue with all the work they have been doing quietly behind the scenes. They may not have been as visible as I but they are certainly the key to any success we’ve had.

I will be representing the DAG at the TSC on Tuesday alongside other members of the team so that any transfer of responsibility is managed effectively and not does affect our long term goal of 100% return for depositors. I will remain in contact with the team to ensure continuity and to help out in any transition but I will not be dealing with individual DAG member concerns or queries and I will no longer be the team’s ‘presence’ on the site.

Should this 'limbo' for depositors continue after 19 February, we believe it will then be appropriate to devise a full blown constitution for the DAG with elected officials to represent the Group. The structure we have had up until now has suited our purpose and allowed us to address issues as quickly as they arose. However, if there is to be a longer, drawn out process, then it is important that the ‘leadership’ have a more robust mandate (as the poll on the site this evening demonstrates) to fall back on in the face of any restlessness within the DAG.

I believe the DAG is very lucky to have the current team working in their best interests and some will probably never know just how much of themselves they have given up for our cause. Those of you who have been so wonderfully supportive in your comments have played a big role in keeping this team going - please continue this great support as they really really deserve it and we need them to carry on fighting to get our money back. We are also off to New Zealand for an extended holiday, booked before the collapse, our spending money now gone, but I'm sure we can enjoy ourselves, the views are free!! We still hope our £1000 payment will come before we leave, sad isn't it to think that 4 months ago we didn't have to think too much about where the money was coming from, we niavely thought its in the bank.

Well done for everything Diver, and I'm sure you'll do great stuff on Tuesday. Sorry if I added to your stress at any point, but if I did it was only ever in what I believed to be the best interests of the Group as a whole, and i do genuinely believe you always did the same.

Really, thats what its about - anybody here can do and say whatever they want...
* If they do it because they believe its in DAG's interests that's great - if it turns out to be wrong then they made a mistake - that's entirely acceptable and human.
* If they act primarily to look after #1, but believing it's nonetheless in the DAG's best interests, that's good too.
* If they act primarily to look after #1, but not really caring whether it's in the DAG's best interests, well, that's perfectly understandable.
* But anyone who acts to look after #1 and simply pretends that it's in the DAG's best interests is a liar.

I really cannot stress enough how immaterial it will be to the group that I will not be an active participant anymore. I am so very appreciative of all the kind comments but they are to a great degree misdirected. It was a GROUP of people that has got us this far and it is almost entirely the same group that will be taking us forward. As I mentioned before, I was just the more visible face of that group...nothing was done unilaterally. A very very large amount of the kind comments on here should be reserved for those that remain at the helm and I'm sure they will make themselves more visible to all of you very soon.

We are in good, safe and more importantly honest hands and I am totally convinced that no sub-group of depositors will be compromised by anything they do. Please keep your spirits up, we've had a better few days recently and hopefully the TSC will give a further opportunity to highlight our issues in open forum.

Thanks once again but let's get away from this topic now and show they guys that they have all of our support.

I doubt it very much, merely a fairy tale to entice you into the cult.

But many of you fell for it, proof that most are still in denial. More proof is that my postings are being removed from the site. There is not a level playing field for all investors. We are surely all entitled to comment or are some of us now being muzzled? Maybe because we know too much?

What will it take to wake you up??

Not even a reminder that YOU ARE NOT GETTING YOUR MONEY BACK with this approach.

Think about what that means to you, what you could have purchased with that money, how it has effected your quality of life, what you will have to do to replace it, if you have the capacity to replace it!

Is that clear enough? Yes, there might be occasional technical glitches which might result in a lost post. Indeed, a restore from backup (has only ever happened once) would result in loss of all postings since the backup point. Also it's possible somebody has hacked into the server (highly unlikely but always possible) and is selectively removing posts of people that he or she doesn't agree with (a strange hacker indeed). It's also possible for posters to edit or remove their own comments - under some circumstances it might happen that they do that and then forget having done so.

Yes, if anyone posts complete garbage, adverts for their Viagra marketing operation, etc, etc, then that will probably be removed.

The subscriptions feature automatically mails out new posts/comments every 15 minutes (to those who have enabled the feature) -- do you really think there is somebody here is checking all postings to decide whether to delete them or not within that time? Since the times are specific (hh:08, hh:23, hh:38 and hh:53) ... so post at hh:07 and it will be mailed out at hh:08, leaving just one minute for the mysterious post-removers to do their dirty-work.

Extremely sorry to hear that you are leaving the "team" but of course wish you all the very best for the future and every success in what you are going to do. It goes without saying that you will be sorely missed. I hope you will keep "posting" your comments as and when you think necessary because we clearly have an uphill path to tread. Picking up on your comments, you said that at one stage you thought the IOM were capable of getting their house in order such that they would be able to provide more information for us at the end of January, why do you think this failed ?

ok big deal, this is not a Diver appreciation society, this is about getting ALL our money back. We are all sorry but now is the time to get focused and get behind the new committee and look after ourselves.

Diver has shown his true colours, sob sob delivery on the site, didn't I do well. For all we know he might have his money (and more, its a big pot). Next week he will be sunning himself on the beach (or has he gone back to Iceland?) wondering how many other investors are going to haul ass to the Isle of Man and knock down Mr Bell's door demanding their money back. It appears that this is the only way?

So we now have three options open to us as individuals:
1. Support the new committee and trust their integrity.
2. Get yourselves over to the Isle of Man, just like Diver did, drop in to see Mr Bell and Mr Shimmin and request your money back. Has it worked for Diver? All very suspicious, I have just lost all my money and now I'm going abroad, yes it happens every day!!
3. Sit around in denial and bounce hard luck stories off each other on this site and wait to get told that you are NOT getting your money back and guess what, we don't have to.

I am taking a combinnation of 1. and 2. Having spoken to the new committee, believe that they are more committed with Diver gone and more determined, they have my full support. They will not however solve your problem without your support. The more investors that knock on Mr Bell's , Mr Shimmins door, the better chance we have.

Ask yourself, what are you doing to assist?

Many thanks Diver for your's and the rest of the DAG's tremendous help. I'll be making another contribution to the legal costs as you are our eyes and ears there since we are overseas.
Can't the IOM government obtain a loan from the UK government to repay all the KSF IOM depositors and so avoid the need for complicated and expensive schemes? Then the 2 governments can sort it out in their own time and possibly at little real cost to and with great PR for both the IOM and HMG. Sounds a bit simplistic I know and no doubt it has already been considered.

Godd luck at the TSC, I'll be watching the proceedings online.

Somewhat illogically, I feel extremely upset that you will not be there as part of the team who are to lead us forward during the next few months. You are one of the few contributors to this site that I can put a face and name to and somehow that has given me hope. Your clear, concise and reasoned approach has been very welcome amidst the bickering and back biting which is often quite depressing.

Well Diver you have given all in the DAG lifeboat the bad news that you are having to give up the task of keeping a firm & steady hand on the rudder.

At the same time you have given the DAG the good news that the task of keeping the lifeboat above the waves of 'the perfect storm' that engulfed depositors 4 months ago has been shared with those surviving that you chose to help you steer the craft through a mutitude of waves that have tried to engulf our flimsy craft.

The lifeboat will not fail because although some will be overcome with fatigue, exhaustion & despair there will be others who will find the strength & will to survive. They will determine to find the way forward to keep body & souls together until one day we hope to see restored to everyone most if not all all that they have lost in this disaster.

You will still be quietly in our midst. I wish you well in the days ahead, & I salute you for all you have done as leader of the DAG.

I don't believe you will be silent--you have a million reasons for not doing so!
If you made the money, which i suspect, you will make it again;it don't make it right though and you have youth and intelligence on your cv.

You deserve to succeed again and you do not need luck to do so.

Whilst I understand and support your need and decision to do the best you can for yourself and your family I too am very disappointed by your departure. In the face of such uncertainty it was always a relief to read your calm and balanced posts on this site. I am sure others on the team will continue to work on our behalf and hope someone will step into your role to present information in a sensible unbiased manner.

Good luck on Tuesday. I am too far away overseas and constrained by work committments to attend in person but will be watching closely. I hope you can get all our information across and that the right people are listening! I support your comments regarding the DAG leadership both at present and if we need to continue the fight long term. Diver's Departure

Diver,

Your news will naturally come as a severe disappointment to all those who have relied on your balanced and frequent updates posted here. One cannot be other than impressed by your excellent dispassionate responses (and sometimes silence) to the sometimes abrasive and accusative postings against you and the team. Your recognition of all those in the core team who have unselfishly contributed is well made. I thank you all equally for what you have done. We have all been massively impacted by the collapse of the bank and the subsequent inaction of the different jurisdictions to right the wrong done to us. I have had to try and recraft my entire life and future to ensure I meet significant financial obligations that would have been met by the money I had on deposit with the bank. For the record, I hit 60 this year, had retired and am in the >500K bracket. It has been the most trying time. No doubt Diver, you face a similar challange and I wish you luck in you move and the future it will bring for you.

I think when I reflect all the developments and events that have taken place, the following seem to sum up in simplistic terms what happened and where the solution lies:-

  1. Iceland; the country over-stretched itself and fell into the finacial abyss. This may have happened with or without the assistance of the UK government. Irrespective of that, it nationalised Kaupthing who had issued the IOM government with a parental guarantee. With the IMF bail out of Iceland having been concluded and the imminent onset of a new governemnt in that country I cannot see that there will be any realistic possibillity of the guarantee being honoured; and

  2. The UK. The UK government used it's powers to seize the assests of Kaupthing UK and place it into liquidation. Their action has been reprehensible, but under the prevailing economic climate it doesn't seem to concern anyone other than the creditors. Some GBP550MM of Kaupthing IOM's money sits in the liquidator's hands and won't be on the radar screen until at least April, and more realistically June at the earliest. I don't see HM's government having a sudden outbreak of guilt or honesty over their actions and returning the money without the process of liquidation taking its course; and

  3. The IOM. Kaupthing IOM lies within the jurisdiction of the IOM government. The UK government has consitently held that our bank's affairs are the responsibillity of the IOM government and frankly, they are correct. Irrespectve of the comfort statements the IOM government have given to us and our representatives, along with the appointment of Alix & Partners, the buck stops with them. It is their reposnsibility to engage the UK government and secure the retun of the banks money held by E&Y, not ours. It is the IOM government's responsibility to ensure the UK government properly represents them in negotiations with Iceland and the honouring of the parental guarantee, not ours. Lastly, it is their reponsibility to act like a real government and take responsibility for what has happened. This means either nationalising the bank returning depositors' monies, or returning depositors' monies and doing whatever they wish to liquidate or run the bank down over time.

We can discard all the UK liquidation matters, Crown dependancy representation matters, Icelandic parental guarantee matters and acting in the best interests of depositors to ensure the best results for them polly woffle statements. These are all distractions and smoke screens. It all boils down to one thing. The solution lies entirely with the IOM Government and that is where all of our focus should lie going forward.

No doubt, others will hold different views with their own supporting rationale, but I wanted to take this opportunity to articulate my own thoughts. I don't post often, but you can be assured I stay glued to what takes place on the site. To those who read this, I thank you for your time.

Very well put and I agree. My original anger has been toward the HMG as they have undoubtedly been the cause of our situauion. They are not looking to bend at all, but it does not appear that the IOMG have really been pursing them hard enough.
It seems that they are not taking our request for 100% seriously. Are we ready to demonstrate at Douglas similar to the Icelandic demonstrations? Should this be done before or after the next court hearing?

Thank you for everything that you have been doing on our behalf. I am sure everyone here appreciates the hard work all of you guys/gals put in.

It is not an easy task to do . You put up with all our anger , frustrations and sometimes even unnecessary comments but you still keep pushing on.

I'm sorry to read your announcement that you're stepping down, despite our differences in recent weeks. Although I knew months ago that you planned to go abroad (a move that I consider to be very sensible since this country has clearly never been in such an appalling mess), I had quite forgotten about it in the excitement of the past few weeks and your announcement is as unwelcome to me as it must be to many other depositors.

It might be as well for you to make it clear that you are not taking up residence in the Isle of Man!

Diver, I for one will certainly be sorry to see you go. You have been the one that has given us, the herd that is following behind, hope when we could see none, positivity when we could only be negative. Would you please inform us all, who will be now taking over your role as the groups informer, of what has and what is going on within the DAG and the informal committee. You have done a remarkable job in keeping us posted around the globe as to what has been happening on the ground. To loose such a valuable mouthpiece and one who, it has been clear throughout, was giving it his all for the benefit of those of us less able to actually do what you have done. How do we find another Diver, one who is equally as strong and equally determined to see justice. Is this now, just going to be a slanging forum between individuals or are we going to see some leadership emerge out of all of this. Or indeed are we as group of desperate mainly retired depositors going to let the IOMG get away without standing up and being counted in times like these. Good Luck and God Bless you Diver, you've been a real gent.

Thank you very much for your kind words. But It's important the everyone realises that nothing changes - anything that came from me was part of a team effort and that team is still here busting a gut for all depositors - just the 'face' will change. The team will make sure everyone is kept as informed as possible and the focus remains keeping up the pressure on all parties involved in this mess and getting all our money back. I have absolutely no doubt that the guys at the sharp end of this have the best interest of ALL depositors at heart and are best placed to fight our corner. They have been there through all the conversations with the IoM, the conversations with our lawyers and discussions with the press...there isn't anyone better briefed than the guys we already have.

The Deemster helped us send a message to the IoM authorities on Thursday that said we wouldn't stand for the stalling tactics, broken promises and lack of information any more. They are now in no doubt that we won't stand around and give them yet more time when they have used what time they had already been given so poorly.

Now is the time to stay together and to get behind the guys that have got us this far, not a time for bickering. A united front will get us so much further.

Dear Diver,

As I remember, just under 4 months ago you were hanging around outside Westminster waiting to pounce on any unsuspecting MP's. In a couple of days you will be inside Westminster and the TSC will be listening to you, and your opinion will be recorded for the whole of UK and the World to see. IMHO a significant personal achievement and a testimony to your determination, integrity and leadership!

You have my sincere thanks and respect. Good luck with your new venture, and trust you will keep an eye on things and stay in contact with your Committee.

Along with everyone else, I just want to say thank you for your excellent work, all the way through. You have always come across as voice of sanity and reason in all this mess. I for one am a bit gutted that you are leaving now, but if that's the way it has to be, so be it and good luck. But you will still be able to log on, and comment, yes?

Just for the record, perhaps you could confirm who are the others on the London DAG team? Who's likely to take your place?

I also came in late to the 'Douglas Nine' episode this last Thursday, so I'm not completely sure who's involved in that, and why etc and what it means.

Anyway, thanks again and too bad you are leaving....

Here, here to all that have said their gratitude to you over the past, horrible four months. Good luck wherever you go and bon voyage ( and better fortune than you've had of late!). Thank you for your effort and unpaid hours of work on our behalf. Do we have any idea who the face will be as your replacement? We have to hold on to something!!! I agree -we have to appear, now, more than any other time, as being a united front - fed up with delay tactics and lack of ethics. I wonder if there couod be a forum set up, for those less financially apt and bewildered by the events, of a simple action plan. Suggest who we should be writing to, venting our anger towards, constructive criticism. I have to say that all the forums, blogs, etc just leave me befuddled as suggestions for contact and actions are all over the website. Remember some of us are less financially apt or less computer literate than others and maybe a forum of suggested contacts ( and the reasons why), which can be added onto as time goes by can lead to more united communication of our efforts and cause.
